TERMS & CONDITIONS OF SALE

Standard Conditions of Trade under which all orders are accepted by Peter Cox (Catering Equipment) Ltd - (‘the Company’). In these conditions ‘Customer’ means any person, firm or company at whose request goods are supplied by the company, ‘goods’ means the articles, things or services supplied to the customer by the Company.

GENERAL
Acceptance of this offer includes acceptance of the following terms and conditions of sale.  Any variation of the terms and conditions of any contract shall become binding only if confirmed in writing by the Company.

MAKING A PURCHASE
Our “one stop shop” makes buying simple.
Browse our shop and add the items you wish to buy to your shopping cart. Check the information box if you have any specific delivery instructions for.
Nearly there now - just click on Final Checkout. You will then be asked for a few details needed to complete your order.
In the event that an item requested is out of stock we will contact you before proceeding with your order.

PRICES
Prices quoted by the Company are current as they appear on the site but we reserve the right to make adjustments if necessary due to currency fluctuations, raw material or factory increases. Unless otherwise stated, all prices are exclusive of any applicable value added tax, for which the customer shall be additionally liable to the Company.

DELIVERY
Delivery dates are quoted in good faith and every effort will be made to comply with dates quoted.  However, no responsibility can be accepted by the Company for delays arising from causes beyond our control.  Furthermore, if manufacture and/or supply is cancelled by act or default by the Buyer, the Company reserves the right to make a claim for loss and expense arising from the cancellation.

DAMAGE OR MISSING ITEMS
Any damage or missing items must be reported to us within 12hours of delivery. The Customer is advised to inspect goods upon arrival.
With all Heavy Commercial Equipment deliveries these items must be checked for damage at time of delivery, signing unexamined will not be grounds for claims.
Carriers will not allow claims if damage is not specifically noted on their docket at the point of delivery acceptance.
If the carrier refuses to wait whilst you check the equipment please sign as damaged.
The Company will not accept responsibility if the above procedure is not followed.

CARRIAGE
Carriage of £5.00 is applicable on all orders under £100 (excluding VAT). For deliveries to remote areas including Northern Ireland, Highlands, Isle of Man, Isle of Wight, Channel Islands, Alderney and Scottish Islands a supplementary delivery cost may apply.
Certain heavy equipment items carry additional carriage charge. Check the details in the item description.

PAYMENT 
Payment must be received in full for the whole price of the goods ordered including carriage charge before your order will be dispatched.
No payment shall be deemed to have been received until the company has received cleared funds.

 CREDIT CARD SECURITY
When orders are placed at our website, credit card numbers are encrypted. Once the card has been processed and approved the details are deleted from the system.
 RETURNS
Goods to be returned for credit will only be accepted with prior agreement and if in their original packaging, unused and saleable as new.   In all cases a restocking and collection charge of 10% minimum will apply. Additional carriage charge costs may apply for heavy equipment. Credit will only be issued once goods are returned and checked.

SPECIFICATION
The Company reserves the right to amend or modify designs, materials or prices without notice.

TITLE 
Title in the goods shall remain the sole and absolute property of the Company until such time as the Customer shall have paid to the Company the whole of the purchase price of all goods which are the subject of this contract or any other contract between the Company and Customer (either solely or jointly with any other party) and for the purpose of these conditions a cheque or other bill of exchange shall not be deemed to be paid unless it shall have been met on presentation. The Customer shall not be entitled to sell or otherwise dispose of the goods without this condition being passed on to the subsequent purchaser or beneficiary.

WARRANTIES & DEFECTS
In lieu of any warranty implied by law, the Company expressly guarantee to repair or replace, free of charge, any components of products supplied which develop defects resulting from faulty materials or workmanship within warranty period stated from the date of supply.  This guarantee does not extend to fair wear and tear, misuse, wilful damage, installation by others or storage, or use in unsuitable conditions.  In no case will the Company accept responsibility for consequential losses, damage or expenses which may result from such defects.
You are strongly advised to have all heavy equipment serviced and maintained annually.

HEAVY EQUIPMENT INSTALLATION
Unless stated prices exclude installation of heavy equipment. Installation can be quoted subject to all mains services being provided within 1 metre and a survey (chargeable) may be necessary.

WEEE REGULATIONS
The Waste Electrical and Electronic Equipment Regulations have come into force.  Should you wish to arrange the collection and recycling of your old equipment please call our Sales Department within 12 hours of placing your order.  Please note that there is a charge for this service.
